1. PREMISES AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
These general contract conditions (hereinafter also "General Conditions") govern the offer by "Soc Agricola Tenuta Campo al Signore srl" with registered office in Località Nocino, 259/b 57022 Castagneto Carducci (LI), Italy, Tax Code and VAT No. IT01657410492. (hereinafter also "Tenuta Campo al Signore") of products on www.tenutacampoalsignore.it (hereinafter also "Website"). The General Conditions must be accepted by the User upon registration on the Website, in order to be able to use the offers formulated therein and to proceed with the purchase of products. Tenuta Campo al Signore reserves the right to modify the General Conditions, in whole or in part, at any time, by notifying Users via the Website with at least 30 days' notice, should the methods of use of the products and services offered be changed. Users are therefore required to periodically consult this page, in order to always be informed about the applied conditions. It is understood that the use of the Website subsequent to such modifications implies tacit acceptance of the same.
2. TYPE OF OFFERS
The name "Tenuta Campo al Signore" is a registered trademark of Soc. Agricola Tenuta Campo al Signore srl. The products on the Website are resold by Tenuta Campo al Signore directly, including in the form of drop-shipping (hereinafter also "Direct Sale") or by commercial partners (hereinafter also "Partners") of Tenuta Campo al Signore. Unless otherwise specified on the product detail page, it should be understood that the products are available in stock and sold directly by Tenuta Campo al Signore. If the products are sold via drop-shipping, this will be specified in the specific sheet of the individual product. Instead, in the case of the sale of products by a Partner, Tenuta Campo al Signore offers a mere intermediation service (hereinafter also "Intermediated Sale") and operates in the name and on behalf of the Partner, considering the sale as a direct agreement between the User and the Partner. Products can be sold both through a permanent catalog and through "flash-deal" formulas, i.e., promotions that provide for product availability subject to quantitative and/or time limits. The product offer relates to the food, alcohol, and accessories categories (wines, spirits, oils, and accessories for the preparation, consumption, or storage of wine). Following a purchase transaction, for products directly sold by Tenuta Campo al Signore or for Partner products in stock, the user will receive an order confirmation and shipping tracking information. In the case of Intermediated Sale goods, the user will receive confirmation that the order has been placed, while shipping will be managed by the respective Partner.
3. WEBSITE REGISTRATION
The Website is exclusively aimed at Users who are at least 18 years of age. The sale and use of the services offered on the Website are made accessible subject to a registration procedure. Registration is free. Users who register on the Website must provide some personal data and follow all the steps of the procedure (hereinafter also "Complete Registration"). At the time of Complete Registration, the User will be asked to choose a Username and a Password, which the user undertakes not to transfer, even temporarily, to third parties and to keep with due care, diligence, and secrecy under their own responsibility, as these credentials are the sole means of identifying the User and validating their access to the offers. The User is therefore informed that all acts performed using said credentials will be attributed to them and will have binding effect on them. The User is required to immediately inform Tenuta Campo al Signore of any unauthorized or improper use of their access credentials or to report any violations by third parties. If Tenuta Campo al Signore finds violations, it may, at its discretion, inhibit access, permanently delete the information contained therein, or refuse the opening of new Accounts by the same User. At any time, the User may update and/or modify or request the deletion of the information provided during Registration. In the event of a deletion request, however, Tenuta Campo al Signore may temporarily retain, in whole or in part, such information, solely for the purpose of executing any purchases made and/or to conclude accounting and tax procedures. Complete Registration is necessary to proceed with the purchase of products and to access summary information relating to the activities performed by the User on the Website (also "Account").
4. CONDITIONS OF THE OFFER
The subject of Tenuta Campo al Signore's offers is the purchase of goods and/or services at the prices indicated on the Website. Tenuta Campo al Signore reserves the right not to proceed with orders from parties other than the "consumer" in accordance with its commercial policy. In any case, Tenuta Campo al Signore does not sell alcohol to individuals under the age of 18. By submitting orders, the consumer guarantees that the ordering party and, if different, the recipient of the goods are both over 18 years of age. Prices are expressed in Euros and are inclusive of VAT. Shipping costs for goods may be a fixed amount or variable, calculated based on weight, the number of selected items, and/or the destination address of the goods. Shipping costs may also be included in the sale price of some items or be free if the total order amount exceeds a certain value or as a result of a specific promotion. The User is, however, always informed of the amount of shipping costs before completing the purchase procedure and making the payment. The images accompanying the information sheets of a product or an offer may not be perfectly representative of its characteristics but may differ in color, size, lettering, and accessory products shown in the picture. All information supporting the purchase is to be understood as simple generic informational material, therefore not referable to the real characteristics of a single offer. The validity of the offers may be subject to quantitative or time limitations, after which they may no longer be available. The validity date and/or the available quantity of the offers are reported on the Website so as to allow the User to be aware of them. Tenuta Campo al Signore may modify the duration or quantity of an offer at any time and at its own discretion, provided that it will process orders placed during the validity of a specific offer. An offer may be published multiple times over time, also following agreements with the Partner or supplier of the goods. In some cases, it is possible that the availability of a good ends after the purchase: in these cases, Tenuta Campo al Signore, if the conditions are met, will refund the User the full amount paid by them, including shipping costs. In the case of promotional sales or through flash-deal formulas as specified above, the full price indicated in the offer ("Strikethrough Price"), against which the discount is calculated, corresponds to: Tenuta Campo al Signore's public list price.
5. PURCHASE PROCEDURE AND PAYMENT METHODS
Having acknowledged the conditions of the offer, the User may complete the purchase by following the procedure on the Website. Before finalizing the purchase, a summary will be displayed indicating the unit cost of the selected good and the total, in the case of purchasing multiple quantities of the same item or different items. The cost of any shipping, delivery, or postal charges may be fixed or variable, calculated based on the weight of the goods, the number of selected items, and/or the destination address indicated by the User during the purchase process. Shipping costs may also be included in the sale price of some items or be free if the total order amount exceeds a certain value or as a result of a specific promotion. The User is, however, always informed of the amount of shipping costs before completing the purchase procedure and making the payment. Once the purchase is completed, the User must proceed with the payment, which will be made to Tenuta Campo al Signore, both in the case of Direct Sale and Intermediated Sale. In the case of Intermediated Sale, Tenuta Campo al Signore will receive the payment in the name and on behalf of the Partner, but will not be responsible in any way for any disruptions created by the partner. Unless otherwise specified on the detail page of the good and/or service, it should however be understood that the products are sold directly by Tenuta Campo al Signore and the receipt of payment will be considered the moment of conclusion of the purchase by the user. Following successful payment, the User will receive an order confirmation e-mail containing information relating to the purchased offer. The e-mail will also contain a reference to these General Conditions of contract. The order confirmation will contain a summary of the delivery and billing address. The shipment of the goods takes place, indicatively, within the times reported on the website. This information is provided by the courier and does not represent a certain date, as it is not always possible to foresee any delays due to the courier in charge of delivery to the Customer or other causes due to third parties or force majeure not attributable to Tenuta Campo al Signore. In such a case, if the amount of the failed purchase should be erroneously charged to the User, the User will be required to promptly notify Tenuta Campo al Signore by sending an email to commerciale@tenutacampoalsignore.it in order to allow Tenuta Campo al Signore to verify the incident and, if necessary, proceed with the refund of the amount paid. Accepted payment methods, unless otherwise specified or agreed with the User, are: credit card or prepaid cards accepted by the Stripe circuit, with a Stripe account, or bank transfer. The debit of the amounts due occurs, unless otherwise specified in the terms of the offer, at the time of payment confirmation. In the case of a bank transfer, at the time of order confirmation, the bank details (IBAN), the amount of the transfer, and the order number to be reported in the reason for the bank transfer will be indicated. Payment by bank transfer must be made within the terms eventually indicated and in any case no later than 2 days from the order confirmation, after which it may not be possible to guarantee the dispatch of the goods: in this case, Tenuta Campo al Signore will re-credit the sender, without additional costs and by bank transfer, any payment received after the deadline. If the User realizes they have provided incorrect and/or incomplete information about their personal details or the shipping address of the goods, it is necessary to communicate this promptly and within the order processing times, by sending an email to commerciale@tenutacampoalsignore.it. In all cases, the User is solely responsible for any indication of incorrect and/or incomplete personal details or delivery address, with the consequent possibility of losing the sum paid if the goods are delivered to strangers.
6. TRANSACTION SECURITY
Tenuta Campo al Signore is very attentive to the security of its Users. The actual payment takes place through protected and encrypted payment data entry fields, served directly by the payment service (Wix, Stripe). Only after the transaction is completed does the banking service provider communicate the outcome of the payment to Tenuta Campo al Signore, without providing any sensitive information. For this reason, Tenuta Campo al Signore has no power over any refusal of the payment method used. Tenuta Campo al Signore cannot therefore be held responsible in any way for direct or indirect consequences deriving from the use of the credit card by the user to make the payment for the products and/or services purchased. Navigation on www.tenutacampoalsignore.it is protected and encrypted according to the highest security standards provided by the WIX Ltd. platform where the website is published.
7. PROMOTIONAL CODES
Tenuta Campo al Signore may issue discount codes (hereinafter also "Promotional Codes") that the User can use when purchasing products. Promotional Codes are issued in the form of an alphanumeric code and may have a value in euros or as a percentage discount. This value is established unquestionably and at its total discretion by Tenuta Campo al Signore. The Promotional Code may be entered by the User in the appropriate "promotional code" field when proceeding to pay for the order. Any promotional code thus entered will be automatically deducted, before payment, from the total amount of the order, excluding any shipping costs. Promotional Codes are generally usable by the user for a limited period of time, after which they will no longer be usable. The Promotional Code may be subject to a minimum spending amount below which its use will not be possible. Unless otherwise specified, the Promotional Code is personal and linked to the User's Account and may be used for a single purchase, after which it will be automatically invalidated. Promotional Codes may not be sold, assigned, and/or transferred to third parties except with the express authorization of Tenuta Campo al Signore and with the exception of the "refer a friend" formula. Tenuta Campo al Signore reserves the right to eliminate Promotional Codes issued in favor of users who make improper use of them, without any notice and without the right to indemnity or compensation.
8. SHIPPING AND DELIVERY
Tenuta Campo al Signore and its potential Partners accept orders with delivery to the following countries: ITALY: islands included, including San Marino, Vatican City, Livigno, and Campione d’Italia. EUROPE: REST OF THE WORLD: The shipment of the good takes place within the maximum time eventually indicated in the conditions of the offer. Delivery times are reported in the shopping cart summary even before completing the purchase procedure. This information is indicative and does not represent a certain date, as it is not always possible to foresee any delays due to the courier. In any case, Tenuta Campo al Signore, unless otherwise specified on the product sheet, undertakes to deliver the goods within 10 working days from the order date. In the remote event that the goods become unavailable for any reason after the order is received, a refund of any payment received will be issued, without charge to the User. The User may be informed by e-mail when the product is shipped by Tenuta Campo al Signore. The User will be communicated, if available, the name of the courier and the shipping tracking code (Waybill or "Tracking"), through which it will be possible to follow its status. This information, if available, will also be visible within the User Account. Tenuta Campo al Signore cannot guarantee that multiple products purchased at the same time will be delivered in a single shipment, nor that any different shipments will arrive at their destination at the same time. It is not possible to guarantee a precise delivery date or time as this depends on the courier, the destination address, and the person in charge of delivery. Tenuta Campo al Signore cannot therefore be held responsible for any direct or indirect consequence deriving from these timings. Delivery of what has been ordered is intended, unless otherwise specified during the purchase process, to street level. In the case of shipping bottles, Tenuta Campo al Signore uses shippers who use patented packaging approved by couriers, designed to ensure the integrity of the product. In any case, upon delivery of the goods by the courier, the User will be required to verify that the packaging is intact, not damaged, or otherwise altered, including the sealing materials (adhesive tape or strapping) or that there is no leakage of liquid. Any damage to the packaging and/or the product must be immediately contested by the User, by writing "subject to inspection" (and specifying the reason for the reservation, e.g., "Punctured packaging," "Crushed packaging," etc.) on the courier's delivery document. Once this document is signed, the User can no longer make any claims regarding the characteristics of what was delivered. Any problems concerning the physical integrity, correspondence, or completeness of the products received must be reported within 3 days of delivery, by writing an email to: commerciale@tenutacampoalsignore.it. In case of non-delivery of the goods within the indicated times, the User will be required to notify Tenuta Campo al Signore by writing an email to: commerciale@tenutacampoalsignore.it, which will directly verify the status of the shipment and any anomaly with the courier. Following a shipping anomaly (e.g., lost or destroyed package during transport), commerciale@tenutacampoalsignore.it will arrange for a new shipment of the product, subject to its availability in stock, without further costs or charges for the user.
9. PRODUCT CONFORMITY GUARANTEE
Tenuta Campo al Signore operates diligently and in absolute good faith in providing products in the quantities and according to the characteristics described in the purchase offers. Tenuta Campo al Signore guarantees that the products supplied are prepared and conditioned in compliance with: EC Reg. 852/04, 178/02 (and subsequent amendments and additions) of the current Italian and EU regulations. The User is also aware that the images used on the proposals may sometimes only be indicative of the product and not always faithfully represent the product delivered. In the case of products that prove to be non-compliant, the User will contact Tenuta Campo al Signore by sending an email to: commerciale@tenutacampoalsignore.it. Tenuta Campo al Signore will, once the anomaly has been directly verified, proceed with the subsequent replacement or refund by crediting the original payment method used or by issuing a Promotional Code equal to the amount of the non-compliant product purchased. In any case, the legal guarantee is reserved for consumers, i.e., final Consumers who have made a purchase on www.tenutacampoalsignore.it, or for purposes unrelated to any entrepreneurial, commercial, craft, or professional activity carried out.
10. WITHDRAWAL
The User who requests a service for purposes unrelated to their professional activity has the right to withdraw from the purchase contract concluded with Tenuta Campo al Signore without any penalty and without having to provide any reason, within 14 working days pursuant to and for the purposes of art. 52 paragraph 1 of the Consumer Code, which run from the day of receipt of the product purchased on www.tenutacampoalsignore.it. The withdrawal may be exercised by the Customer, pursuant to art. 54 paragraph 1 of the Consumer Code, using the reason "RETURNS & REFUNDS" from the form on the CONTACTS page or by presenting any other explicit declaration of their decision to withdraw from the contract, to be sent either by registered letter with return receipt, to Tenuta Campo al Signore, with registered office in Località Nocino, 259/, 57022 Castagneto Carducci (LI), Italy, or by email to commerciale@tenutacampoalsignore.it. The registered letter with return receipt and the e-mail must contain an indication of the product and the order number. The burden of proof relating to the correct exercise of the right of withdrawal, in accordance with the above procedure, rests with the User. Following the correct exercise of withdrawal, unless Tenuta Campo al Signore collects the goods directly, the User will be responsible for returning the goods without undue delay and in any case within 14 days from the date on which the User communicated their decision to withdraw from the contract to Tenuta Campo al Signore pursuant to art. 54, c. 4. The User must visibly apply to the packaging the document received from Tenuta Campo al Signore following the above-mentioned withdrawal communication, which already indicates the shipping address and order details necessary to identify the return at its destination. The User is advised to also include a copy of this document inside the packaging, in order to avoid its loss or the impossibility of identifying the return once it arrives at the warehouse. The relative shipping costs of the goods will be borne by the User, unless Tenuta Campo al Signore has not informed the User about this at the time of concluding the contract, in accordance with art. 57 paragraph 1 of the Consumer Code. The goods must in any case be kept, handled, and inspected with normal diligence and returned intact, complete in all their parts, accompanied by all accessories and instruction sheets, identification tags, original labels, and capsules, where present, still attached to the goods and intact and not tampered with, as well as perfectly suitable for their intended use and free of signs of wear or dirt. As provided for by art. 57 paragraph 2 of the Consumer Code, the User is responsible for any diminished value of the goods resulting from handling them in a way other than what is necessary to establish the nature, characteristics, and functioning of the goods themselves. In this case, Tenuta Campo al Signore, after written communication to be sent to the User within 5 working days of receipt of the goods, may reduce the refund amount due to this diminished value, providing the User, if the refund has already been paid, with the bank details for the payment of the amount due by the User due to the diminished value of the goods. Tenuta Campo al Signore may refuse to accept a withdrawal for food products that have been consumed, even partially. Pursuant to art. 59 of the aforementioned Consumer Code, goods made to measure or clearly personalized or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly are excluded from the possibility of withdrawal.
11. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
It remains understood in any case that, with reference to service provisions, the right of withdrawal may not be exercised by the User after the complete provision of the products by Tenuta Campo al Signore if the provision itself began with the User's express agreement and they accepted to lose the right of withdrawal following the full execution of the service by Tenuta Campo al Signore. In any case, pursuant to art. 59 of the Consumer Code, goods made to measure or clearly personalized or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly are excluded from the possibility of withdrawal.
12. REFUNDS
Any disbursement of sums as a refund by Tenuta Campo al Signore, if due, will take place pursuant to art.56 paragraph 1 of the Consumer Code as soon as possible, and in any case no later than 14 days from the date on which the event giving rise to the refund occurred and, in case of withdrawal, from the day on which it became aware of the relative exercise by the User. Tenuta Campo al Signore will make the refund using the same means of payment used by the User for the initial transaction, unless expressly agreed otherwise with the User and provided that the User does not have to bear any costs as a consequence of using a different means of payment. If the User has expressly chosen a different type of delivery that involves higher delivery costs than those associated with the standard delivery offered by Tenuta Campo al Signore ("Supplementary Costs"), the latter will not be required to reimburse the relative Supplementary Costs. It is understood that, except in cases where Tenuta Campo al Signore has decided to collect the goods directly, Tenuta Campo al Signore may withhold the refund until it has received the goods.
13. LIABILITY
Tenuta Campo al Signore will not be liable for damages that may derive from the use of the Website such as omissions, service interruptions, and software failures, including damage to the User's computer equipment, which prevent or delay the provision of services if these are due to external causes, force majeure, and/or third parties not dependent on the owner's will. Tenuta Campo al Signore will only be liable for any defects or discrepancies found in the Direct Sale, while in no case will it be liable for any defects or discrepancies found in the Intermediated Sale, for which the Partner will be exclusively liable to the User. Consequently, the User is informed that in such situations they must address their complaints and act exclusively against the Partner. In any case, Tenuta Campo al Signore and/or the Partner cannot in any case be held liable for delays or defects or discrepancies dependent on events beyond their reasonable control such as, by way of mere example: (i) force majeure events; (ii) events dependent on third-party actions such as the interruption or malfunction of telecommunication operator services and/or power lines, or acts or omissions by carriers or shippers.
14. COPYRIGHT
Tenuta Campo al Signore is the owner of all rights relating to the website content (texts, images, files), as well as its own distinctive signs made visible therein. Reproduction, even partial, of the content and graphics of the Website, as well as the distinctive signs made visible therein, is therefore prohibited.
15. PRIVACY
Personal data is collected and processed in order to respond to User requests. Tenuta Campo al Signore guarantees its users that it operates in compliance with the legislation on the processing of personal data, governed by the Privacy Code referred to in Legislative Decree no. 196/2003. The privacy policy is to be considered an integral and substantial part of these General Conditions and is accessible in the Privacy section of the Website or from the link: The data controller is Soc. Upon Registration, the User may be asked to give their consent to receive commercial information, including through the sending of newsletters. In this case, the User will be free to give or withhold their consent.
16. APPLICABLE LAW AND COMPETENT COURT
These General Conditions shall be governed in all respects by Italian law. For any dispute concerning the interpretation, execution, and/or termination of the contract between the User and Tenuta Campo al Signore, in the case of Direct Sale, or between the user and the Partner in the case of Intermediated Sale, the Parties acknowledge that the competent court will be that of the User's place of residence or domicile, if the User is considered a "consumer" according to current laws on the matter. If, however, the User is a professional, in the case of Direct Sale, the Court of Livorno will be competent, while in the case of Intermediated Sale, the Court of the Partner's place of domicile will be competent.
